QUESTION

Can I resign as executor of an estate?

Asked on May 22nd, 2018 on Trusts and Estates - New York
More details to this question:
I am executor of my parents’ estate, which includes the family home. The house has been in foreclosure for over five years, but my younger brother has been living (squatting?) there. As executor, am I libel for anything? I cannot get him to leave the house and he insists he is trying to buy it. He has been paying utilities but has let the insurance lapse and hasn’t paid taxes. The house is in New York and I live in North Carolina. Am I libel for anything? I’m not sure if I need an attorney. Can I possibly resign as executor and let him handle it?

You can resign with a petition.  If everyone consents there is no court hearing and it is not expensive.  Or, just deed him the house to close the estate.  This may be an option, depending upon the terms of the will and your letters.
