QUESTION

Can I sue my father over inheritance money?

Asked on Aug 30th, 2017 on Estate Planning - Illinois
More details to this question:
I am 27 years old and it has come out that my late grandmother left me nearly $60,000. She died in 2002. I have documents stating the amount she left and the trustee is my father whom I am quite estranged. Can I sue him for this? How would I go about it and would there be interest on it given how long it's been? I'm not terribly surprised he took it but that money could have put me through college and set me up for a good go at life.

If he breached is fiduciary duty as Trustee, then you would have a case against him. This would need to be proven in court. You could request interest and may get it?.especially if it comes off as there was some ill will in the decision not to give it to you.

If the trustee received funds entrusted for your benefit and the funds were redirected then you could have a cause of action against the trustee. There are many factors involved that can affect the efficacy of such a law suit. Collect all the documents and information you can find and bring them to an estate and litigation attorney to review and advise you of your options. There are statute of limitations issues that can affect your ability to bring the lawsuit. You should act quickly.
