My parents have 2 city lots one has the old home condemned and the other I have put a mobile home on. My sister and I were to each inherit a lot. My father passed away in 2003 the property was put in an estate and never probated. My mother started having dementia /Alzheimer's in 2011. My sister filed a document last summer that she purchased the property both lots for $20 from my mom - without my knowledge and had just sold the property to someone. What can I do? How was this able to be done without my knowledge?
First, your father's estate must be probated by a Court heirship proceeding, small estate affidavit or Affidavit of Heirship, passing his interest to your mother (if all his children are her children).
Second, if your mother lacked legal capacity to contract when she "sold" the lots to your sister, report elder exploitation to Adult Protective Services.
Third, if the person who purchased from your sister did not know all this, your remedy is to sue your sister for the money she got from selling the lots.
