Can someone prepare and file a partition act? and how much would it cost?

My siblings and I own a house that my mom left when she died. My brother currently lives in and has lived in it for approx. 20 years for free. He refused to pay rent when asked and has refused to move out so we can sell it. He doesn't want to buy it. My mom passed on 9/15/2018. Her lawyer said to do a partition filing so he would be forced to move out, so it could be sold.
