Asked on May 27th, 2015 on Estate Planning - Pennsylvania
More details to this question:
We inherited a cabin and real estate from parents. It is split 50/50 with cousins. We want to sell. They will not pay 50 percent of value or sell their half. Can we force the sale of whole cabin? Are they obligated to pay 50% of appraisal value?

It is very difficult. If you cannot agree on a buy out price, it is really hard to get them off the deed. If you want to force a sale, you need to hire a lawyer to file an Action for Partition of Real Estate. It is a lawsuit and it is costly. If they are not paying taxes or upkeep, you should notify them in writing and request payment. Review this with a local real estate attorney.
