QUESTION

Distribution of equity, no will

Asked on Dec 15th, 2024 on Estate Litigation - North Carolina
More details to this question:
My parents have a large estate. It is to be split three ways, no will. My question is.. we all have been waiting over a year now. One of their houses have sold & we were told after they checked on taxes we could get disbursement why we wait on the other house to be sold. Is this true or do you have to wait til the very end? One more issue I’m having is my brother had a title put in his name. Is that fair & ethical if noone else has received anything from the estate? Thank you in advance!

I see you are posting regarding a matter in NC.  I do not know NC law but in most states distribution of estate assets to Beneficiaries may not commence until a period of time provided by law has elapsed, usually a year.  If all of the debts the deceased left behind are not paid then most lawyers advise that Executors delay distribution until creditor claims have been paid or settled.  This could be the reason for the delay.   You should probably get an attorney to represent you there to find out the reasons for any delay.
