QUESTION

Do I have access to my stepdad's accounts after he dies?

Asked on Sep 21st, 2011 on Estate Planning - Georgia
More details to this question:
My mom is married to a man that is about to pass away. He has assets that were obtained while he has been married. He has a will and accounts that he has not told me about or I do not have access to. When he dies do I have a legal right to any of these? I think he has left everything to his daughter.

The only people who have access to an account after death are persons named on the account (POD beneficiary/joint tenant/ co-owner) and persons who have been appointed to serve as personal representatives of an estate. Unless you meet those criteria, you would not have access.

When he dies, the person he named in his will is the one who will handle things. Your mom will have a claim for a share of his estate, even if he has disinherited her. You will not.

A stepchild has no rights whatsoever to a step parent's assets, with or without a will, unless the will leaves them something.
