QUESTION

Do I need a Last Will and Testament?

Asked on Apr 09th, 2021 on Estate Planning - Missouri
More details to this question:
Do I need a Last Will and Testament? I have a Durable POA and Living Will. I have also added TOD to my titles and have recorded Beneficiary deeds for my real estate. My life insurance has my 3 adult children named as beneficiaries and they will use that to bury me. I have given away all of my other assets and I am debt free. My wife proceeded me in death and I have not remarried. After doing all of that do I still need a simple will?

You may not.  In most states if only a small amount does not pass to designated beneficiaries, your heirs can file a Small Estate Affidavit.  This is less expensive than probating a Will.
