Do I need a Will?

My husband doesn't want a will because he doesn't want to face it. My dad died. He had a will.

Generally speaking, yes, everyone needs a Will.  While estate planning is an unpleasant subject to discuss, it's something that needs to be addressed.  If nothing is done you're stuck in the probate court for potentially a very long time.  You have no control over how your affairs are managed, who is involved, and who gets what.  You also have the ability to nominated a guardian if you have any minor or disabled children.  If nothing else, it will make a difficult time a little bit easier to get through. If you may leave more than the limited amount qualifying for a small estate affidavit in your state and either want things to pass differently than they would under the laws of heirship in your state or want to save your family the cost of a court determination of heirship, you need a Will.
