Do I need an attorney to receive funds from probate?

More details to this question:
deceased did not leave beneficiary to 401K. How do his children get the retirement funds? Do we have to get an attorney or will it just eventually come out of the probate system?
1 ANSWER
You will need to open a probate estate to get the money. If it is under $25,000, then you can open a small probate estate without an attorney. If it is more than $25,000, then you will need an attorney to open a probate estate in the county where the deceased lived.
