My family just discovered there was stock in my dad's name (who died in 2006). When my mom was alive, my brother (whose name is the same as my dad's) lived with her in our family home. I was recently told by my brother that a check would come in and he would cash it for our mom. In 2013, my brother had a major stroke and my mom had to be cared for in a nursing home. My brother's ex-wife came to the family home where she lived and took care of my brother. In April 2016, they had to move out so I could sell the house and use the money to care for mom. During this entire time, neither myself or my other siblings knew anything about this. My brother's stroke caused him to forget about the checks. Meanwhile dividend checks were still being cashed. Not a single one went uncashed. I believe our ex-s-in-l was forging the checks and cashing them herself. I live in Ga and I'm going to Va to probate court in a couple weeks. I don't want my brother to be harmed by this situation.
Please discuss this with your probate attorney. A suit may lie against your sister-in-law for forgery, fraud and conversion (converting someone else's property to her own.)
