QUESTION

Do we owe our deceased father's rent?

Asked on Feb 19th, 2017 on Estate Planning - Oregon
More details to this question:
Our father died on January 31 2017. We moved and cleaned the house. He was renting and handed the keys in on February 17 2017. The landlord is saying we owe a prorated rent of $1144.08. Our father lived alone and there is no executor. However, my sister was his payee when he was alive because he was disabled. Are we or she is responsible for paying his rent when none of us lived there?

Any person who inherited property or money from your father is responsible for paying his creditors, to the extent of the value of what they inherit. However, there is a priority for payment of creditors; if your father was receiving any public benefits like Medicaid or Oregon Health Plan, there might be an amount payable to the Oregon Department of Human Services. One of the creditors would be landlord, who is owed rent until you turned the keys over. But if no one is inheriting anything, then no one needs to pay anything.
