QUESTION

Does the insurance company have to recognize his beneficiary change request?

Asked on May 28th, 2015 on Estate Litigation - Georgia
More details to this question:
I cared for my elderly family member until his recent passing. I was established as fiduciary for his pension about 2 years ago due to his many health diagnoses, including dementia. About a year ago, he completed a beneficiary change form, to change his designation from my mother (who pre-deceased him) to me, as he has no other heirs. Upon his passing, I received a letter from the insurance company stating that because his designated beneficiary (my mom) pre-deceased him, the insurance proceeds would go to his estate. It appears that they did not honor his change request. Is it worth it for me to challenge this? BTW, I am named as heir to his estate, which means I will end up receiving it anyway, but in this case, would it end up being taxable?

As you inherit the estate either way, you should not worry about the issues.  If however, there are significant bills for the estate to pay, you need to figure out a way to get the insurance company to honor the change form.  You will need to hire an attorney to help with this matter.
