My mother left her home to her six children. We have submitted the will and everything seems to be going well. But my two sisters live in the home and we want to vacate the home to put it on the market. My brother, as the executor of the will, wants to send out a letter to the two sisters giving them notice that they need to move out by a certain date. How should the letter be worded legally to make sure that they leave the house? Also, what if one of the sisters refuses to leave? what recourse do we have?
The attorney who is representing the executor should be able to tell you how to draft the letter and what notice, if any, must be given before going to court to evict the sisters.
