QUESTION

How do I cash a state check in my deceased daughter’s name?

Asked on Jan 27th, 2015 on Estate Planning - Washington
More details to this question:
The sent me a check in my daughter's name. I called and ask if they would send one with my name on it and their response was that now that they know I received the check as far as they’re concerned the estate is now considered closed. I have papers showing I am the successor to her estate but my local bank will not accept the check, not even for an estate account. What do I do?

Most banks do not understand the Small Estate Affidavit requirements in Washington. What they are forcing you to do is petition the court to be appointed Administrator of her estate. You will receive letters from the court as the Administrator. Further, you will need to get an EIN from the IRS. They will give you this over the phone. With these two documents you can open a bank account for her estate. That will allow you to deposit the check as well as later withdrawing the funds. Filing fee in Washington is $240. Letters are $5 each.
