QUESTION

how do I determine it I have a QTIP trusts or a Marital Deduction trust?

More details to this question:
our trusts states that it is "our intent that the Marital Deduction Trust property constitute Qualified Terminable Interest Property (QTIP) for death tax purposes and to the extent our Trustee makes the necessary elections". I can't tell what we have.

It seems like you have the election to use a QTIP if you like.  Speak with an estate tax expert about whether your particular circumstances benefit by such an election.
