How do I file a petition to file my deceased mom’s will?

More details to this question:
My mom has passed at 66 years of age, on January 26th, 2014. Her husband has not filed their will! It will be three years this January, that my mom’s gone. Lots of other cash, investments, policies, are existent as well. I don't have the cash to pay a lawyer outright, to help get him to file. I've asked him countless time if he’s filed. He totally ignores me. He's done a lot of illegal things along the way as well. Including: Using my State Health Insurance for my brother’s medical needs. I have the statements from Medicaid/care as proof! He had continually claimed me as a dependent on his taxes as well! A lot of money is involved here. He is also a compulsive gambler as well as liar.

Go to the Surrogates Court in the County where your Mother lived. Find the Probate Clerk and ask him/her for the necessary forms and instructions.
