QUESTION

How to foolproof a trust from a contest by beneficiary

Asked on Jan 23rd, 2016 on Estate Litigation - California
More details to this question:
Have a living trust and very good reasons for changing beneficiaries. One beneficiary has indicated that they will challenge trust after my death. Why or how can my wishes be challenged or changed after my death? I thought that that was the whole purpose of making a trust, so that your wishes are carried out and not the courts.

Anyone can contest your trust.  However, your trust should include a "no contest" clause that provides that if a beneficiary contests the trust, that he will get nothing.  In the trust, give that beneficiary a nominal amount.  Then if they contest, they get nothing.
