QUESTION

How would I go about cashing this check since it indicates he’s deceased?

Asked on Mar 12th, 2016 on Estate Planning - Ohio
More details to this question:
My father passed away on January 1 2016. He was never married and I'm his only child. I filed his taxes and they were supposed to put the checks in my name. Well, I received his state check today and it has his name on it. The check is made out like this using a fake name with our address underneath his name. The DECD stands for deceased. Should I just take his death certificate with me and my ID to show I'm his daughter? Should I bring my ID, my birth certificate and his death certificate to cash it? He never had a power of attorney or an estate or a will. I need to figure out how to cash it ASAP so I can finish paying his funeral expenses. I haven’t received his federal income tax refund check yet so I don't know if it's going to be in mine or his name. If it’s in my name, what do I need to do to cash this check a legit way?

You need to file a low asset estate with the local probate court. In Ohio, it's called a "Release from Administration" and it costs $35.00. That will give you a court document which lets you cash checks in the deceased name as well as to transfer any other property that he may have owned when he died.
