QUESTION

I live in CA - do I need NY attorney?

Asked on Mar 04th, 2016 on Estate Litigation - California
More details to this question:
My ex-husband passed away a year ago and estate is in probate. I believe it is being probated in NY as that was his last US address. Per our divorce settlement agreement I am owed stocks and some priceless household items. The executor of the estate sent email in November 2015 to confirm shipping address stating that he had located some (but not all) of the items and would be shipping soon. He also said that the stocks were ready to be transferred to my name and to provide brokerage account info. I have done all of these things but he (executor) is no longer responding to emails or phone calls. Last I heard from him (January 12, 2016) he was going out of the country and would take care of it on his return. It is now March so I'm at a loss as to what I should do to move this along...

Probate cases take time.  I've never seen a probate attorney in a hurry.  I explain to my clients that nothing happens for months at a time in a probate case.  Be patient and persistent.  Continue to call and write to the executor or his attorney.
