QUESTION

Is it possible to remove someone from being on an estate?

Asked on Aug 09th, 2011 on Estate Litigation - North Carolina
More details to this question:
The house that my wife and I currently live in is in estate. It was left to my father-in-law and his sister as the executors. It still has a mortgage which we pay. We want to know if it is possible to remove my father-in-laws sister? The estate has been closed, so there are no other matters for them to take care of.

It is unclear to me exactly what you are trying to accomplish here.  It sounds like your father-in-law and his sister are the owners of the property, pursuant to the will that left them the property.  You could potentially petition to have the property sold, but your father-in-law's sister will be entitled to her share of the proceeds.
