My grandmother died in November of 2017 and my aunt, who is the executor of the will, has still not carried out the stipulations on the will. All of her belongings were to be divided equally amongst her 6 children upon her death. Her stocks and bank portfolios have only been distributed to 3 of the 6 children and her house still has to be sold. I have been living in the house my entire life with my grandmother and I have been the caretaker of the house while also paying the taxes on the house. I would like to buy the house from the family and have support from the majority of the family but the executor of the will (my aunt) wants to postpone the sale of the house for the next 2 years. Is there some type of statute of limitations in which her waiting to sell the house will benefit her?
Check with a local probate attorney. In some states any beneficiary under the Will can demand an accounting a certain amount of time after the executor is appointed and, if distributions have not been made within a certain period thereafter, ask the court to replace the executor.
