More details to this question:
My step mom died, we know everything goes to my dad, no contest, but now he can't find the will. Do we need it or just act as if there is none and file for everything that way?

If everything they owned was owned jointly, then you do not need to find the will.  If there is something that she owned in her own name, your dad will need to apply to be the administrator of her estate.  You can get assistance in doing that form the Surrogate's Office of the county in which your dad lived at the time of your step mother's death.
