mothers house estate

More details to this question:
long story my mother died in 2007 she left a house it went to probate court one half went to my step father the other half went to my sister,broher and i. It was rental property so we let step father have all the earns of the house with him takeing care of up keep and taxes and when he died we got his half on his death.Well he died in Oct. and so his half went to us 3 but my brother also died last year. I called the court house and they said it was still in my mothers name for us to bring paper which we do have stateing on his death it came to us. But we need death certificates from all parties do we need a lawyer to do this and do we have to worry about his kids stepping in?

talk to a local lawyer, as there are some issues here. how the house was titled, is a big one. If it was tenants in common, his share goes to his heirs. if it was held joint tenants with right of survivorship, it goes to you and sis. you may owe inheritance taxes. you really need professional help.
