QUESTION

My cousin stole my inheritance

Asked on May 31st, 2017 on Estate Litigation - Pennsylvania
More details to this question:
My cousin was POA for my aunt's estate. My cousin dragged my aunt out of her home after 94 1/2 years, put her in a nursing home, sold her house for $270,000 and then put the money into a joint checking account with her and my aunt that was supposed to be a convenience account, and then when my aunt died she stole the money and gave me some, but not my share. I was listed in the Will in equal shares with my cousin, the executrix.

The act of your cousin depositing the sale proceeds into a joint account could be a problem.  If the cousin was power of attorney for your aunt via a written POA document, you'd need to review that document to see what powers your aunt gave to your cousin.  She mght've given your cousin the right to do what she did.  However, your cousin would have had a fiduciary duty to act in your aunt's best interest.  That's a suspcious action taken by your cousin that bears some investigation.
