My mother in law is a an acholic and has something called wet brain (achol induced dementia) she can't write a will. She has no living will much less a regular one. My husband and I are trying to get things ready so we can pay her bills and probate her estate. (When the time comes) The doctors don't give her long maybe a month . Her husband left her a million plus in her in saving account plus stocks, bonds and part ownership of a real estate business. My husbands brother is the issue. He wants to probate and take over. He has no state issued ID. he has drug and alcohol problem as well. He can't pay basic bills. The power at her house was shut off while she was in the hospital (we had to come up and pay it.) The taxes on the house have not been paid. Things are getting out of hand and we just want be able to do right by her pay her bills while she is alive including hospice care. (Hopefully at home like wants) settle her estate and give her a funeral.
Hire a local probate lawyer and file the New York State equivalent of an Application for Determination of Heirship and Issuance of Letters of Administration.
