I have poa/guardianship of my 45yr old Down syndrome step sister since my step mother died because her father only has her a few days a year. I went out of town for 6 weeks and he kept her for me. In my absence he's has gotten his own lawyer, been able to access her records with the state, has gotten his own durable power of attorney and is claiming he may allow her to visit me. All this just seems impossible to me. Does he have the right?
Did you get guardianship through a probate court? If not, you should file in probate court to get a real judicial guardianship. As you see, a power of attorney doesn't carry much weight. If a judge decides who is guardian of her person and her estate, no one can change that without going to court.
