QUESTION

Property will

Asked on Jan 28th, 2016 on Estate Planning - California
More details to this question:
My parents left their home to be split up between their children (4) . They wrote it down in their will. My younger sister is on the home title. She has been keeping all the earnings in rent and refuses to sell the house ( like all of us have agreed on) and divided the money between us. We want to know what is possible to do. There is a will and it says this exactly we all must share the earnings from the house.

You'll have to sue to get an accouting of what was received in rent and what amounts you will be entitled to.  Furthermore, you should file a partition action requesting the court that the property be sold and that the proceeds be divided between the co-owners.
