QUESTION

retainer fee for Trust distribution

Asked on Jan 24th, 2015 on Trusts and Estates - California
More details to this question:
Do lawyers typically require retainer fees for representation of a beneficiary of a Trust? My mom's lawyer is representing the executor , my brother, and I am looking for an attorney to make sure everything goes fine. Her lawyer is excellent, so maybe I should wait and see how things go.

Each case and each attorney are different. However, I would think the majority of attorneys would want some kind of retainer in a trust matter as you describe. Again, though, each case is unique. You might contact a couple of experienced probate attorneys in your area. Maybe you can find one who would take the case without retainer. It is certainly possible.  Good luck.  -John
