We retained a Probate Attorney in early Nov 2013. As of today, April 14, 2014, I still do not have an executorship to handle my dads affairs. The Attorney has repeatedly filed the wrong paperwork with the court. I don't know what to do at this point. If I replace him, does he still get a percentage of the estate when it's eventually settled or is he only entitled to his expenses thus far?? Thank you.
Sounds like it might be wise to proceed with a new attorney. Your old attorney would likely be entitled to the reasonable value of his services and any out of pocket amounts he has paid.
