QUESTION

Townhouse in my name only

Asked on Sep 28th, 2013 on Estate Planning - New Jersey
More details to this question:
My husband and I have no children. We have separate accounts with each other as POD on all accounts. I bought my townhouse before we were married; therefore, it is in my name only. Is there a reason to put the townhouse in both names. I'd rather avoid probate just for this townhouse, when everything else passes to the surviving spouse?

If you put your husband's name on the deed you can do it as joint tenants with right of survivoship.  That way the townshouse will pass to himautomoatically upon your deaht, and will pass to you automatically upon his death.  Without changing the deed, the property will not pass automatically to him on your death even though you are husband and wife.
