QUESTION

Trust & Accounts

Asked on Sep 24th, 2013 on Trusts and Estates - New Jersey
More details to this question:
I right after my mother passed away. This family member had me sign some legal papers. At the time I did not know what I was signing because my feelings were all over the place. Later I found out what signed was a will & trust for other family members. Which meant that if anything ever happened to me it would go to their family members. He took control over a checking account and made it into trust account.. He has his name on that account & mine too. I also have a copy of mom's will which says nothing about a trust account. Can you please help with this legal matter.. I have tried other lawyers in person. All they want is how money to do the job. Thank you for listening .

Go to the Surrogate's Office in the county in which your mother died.  Her will had to have been admitted to probate, and the Surrogate's Office will have information regarding that.  Ask the people at the office what you need to do to challenge something the executor of the estate did and they may be able to help you.  If you consented to the trust, the trust might be revocable, meaning you can revoke it at any time.  If that's the case you can dissolve any trust that was created and access your own money.
