QUESTION

Uncle's Estate

Asked on May 21st, 2021 on Estate Planning - New York
More details to this question:
The Attorney and my cousin are executors of my Uncle's estate. My uncle passed in 2010 and the estate has not been settled. There has been partial distributions to the beneficiary's. My Uncle was a financial planner and apparently his estate is still receiving commission payments. The Attorney (Executor) is stating that the estate cannot be settled until the commissions end. My cousin (executor) has not received any written update of the estate settlement since 2010. Does my cousin (Executor) have to hire another attorney to get things closed?

The short answer is that a fresh set of eyes may be a good thing.  There are many ways to deal with the on going commission income, but more facts would be needed. Partial on going distributions are the preferred method of addressing the problem.  Lee David Auerbach Auerbach Law Group, P.C.
