More details to this question:
my brother is half owner my mother passed and no transfer upon death was made they said i have to go through probate but i want to know since i have taken care of the property since she turned ill and my 2 younger brothers havent stepped foot in the house in 6 years do they have rights to claim just their portion of the property

Yes, if there is no will, then she passed away "intestate." State laws regarding inheritance rules apply and it does not factor in what care you provided for your mother. You are all heirs of equal standings and therefore have an equal share.
