If you father dies without a testament ("will") the default laws for intestate ('without a will") succession go into effect and the distributions are made according to the law.

If he dies without a will, there are certain default rules that will determine who gets the property. In this situation, ownership of the estate would be split evenly between his children. If he has a wife, she will get a fructose over property, which means she will have possession and use of the property. There are also other factors to consider.
