QUESTION

What can a beneficiary deduct

Asked on Jul 14th, 2016 on Trusts and Estates - California
More details to this question:
My parents had a trust before passing away that is to be distributed among their 4 daughters. One of the daughters, my sister, is the Executor of the trust. Due to concerns about how the trust is being distributed, my other sisters and I would like a lawyer to review the trust to determine if the trust is being distributed equitably. Can we deduct, from the estate, the lawyer fees to review the trust and related documents?

Maybe.  Ordinarily, beneficiaries must pay for their own attorney's fees.  However, if the attorneys fees benefit the trust, then you could charge the trust for your attorney's fees.  It's complex.
