My son gained custody of his two minor children a couple of years ago when the state of michigan to custody away from their mother due to drug use,mestation an neglect. So my grandkids went to live with my son, their dad and his wife, their stepmom. Now my issue is my son was just killed a few weeks ago in a car crash. The kids are still wth their stepmom but as their biological grandmother I am concerned about their best interest and am wondering what can I or his siblings do to seek gaurdianshi?
If the mother's parental rights were legally terminated, voluntarily or involuntarily, you may be able to become your grandchildren's guardian. In some states they must have resided with you for six months first.
If the mother's parental rights were not legally terminated, voluntarily or involuntarily, she may be willing to sign a special form of power of attorney, revocable at will, which allows the children to live with you and allows you to enroll them in school, take them to the doctor, etc.
