The family believes our Aunt and Uncle are subject to Elder Abuse. A friend of my Aunt and Uncle has pressured them sign a trust document. All they wanted is a simple will. This document makes the ยฟfriendยฟ the sole trustee of an estate worth $5.5 million with nothing to the family. This happened April 2012.The daughter is unable to obtain a copy of the Trust document to review. The ยฟfriend ยฟ has the documents and will not to show it to any family members. His attorney drafted and is in retaining the signed document.
In addition, we believe that he and his wife have started to transfer assets. My uncle is 92 and was sent to a rehab center in June after a fall. He was determined in Nov ยฟ Dec 2011 to have the onset of Alzheimerยฟs .I have asked my Aunt, who is 91, what she signed. She thinks it''s a Will, but is not sure. We need some guidance on what to do before they are cleaned out and left penniless. Do we have a legal ground to pursue litigation?
