Who pays for Termite Infestation?

More details to this question:
I bought a house recently with my fiance over a year ago. In the house contract they told us they had termites and the seller was suppose to pay to get rid of them. She did but they've already came back we just recently found out we have them again. They are everywhere in our walls and have been in all of our wooden furniture and its all damaged.I was just wondering do we have to pay for all the damage to our house and our personal belongings, or does the insurance comp. or the morgage company pay it all or atleast half?

As a general matter, your acceptance of the deed to the house constitutes a waiver of any claims against the seller with respect to the physical condition of the house. When termites are present, and the buyer closes anyway, normally the buyer must look solely to the terms of the contract with the exterminator. You must carefully review your purchase contract and the terms of exterminator's agreement. It is not possible to answer your questions from the limited information provided. You should see an attorney if the damage is substantial.
