Asked on Nov 20th, 2015 on Estate Planning - Ohio
More details to this question:
My husband owns companies and has nothing in his name. I signed a prenup before marriage regarding all companies; however, at that time my husband signed an addendum to his will leaving me "X" amount of cash. So my question is would my portion of the will override the prenup?

Yes, a will overrides a prenup. A prenup limits the amount that a widow/widower can claim against the estate of the deceased. If the deceased chooses to give the widow/widower more, that's their right.
