More details to this question:
My brother and I are beneficiaries to an estate. He is the executor of the Will and I am the successor executor. Four months has passed and my brother has yet to file as administrator of the estate and the estate's property is about to go into foreclosure and to save it the names on the deed have to be changed. Is there any way that I can file as administrator? Time is of the essence with this. Thank you.

You absolutely can and should file.  There is a specific petition to file when the named executor refuses to serve.  It is called "cta".  We do it all of the time.
