My grandmother passed away 6 months ago. She had drawn up a will with my grandfather before she passed. My grandfather has grown spiteful toward the family since her passing (he is in the early stages of dementia) and says comments like he has "cut everyone out of the will." I know my grandmother left meaningful family heirlooms to several family members. My grandma is my blood relative and my grandpa is married into the family. It was my grandfather's responsibility to carry out her wishes and he never has. With his progressive mental disease and his irrational and disturbing comments/thoughts we are fearful her wishes will not ever be carried out and that he will change what she wanted to have happen. Is there anything we (the family) can do?
Submit her Will for probate. If you do not have the original, talk with a local probate attorney about the possibility of probating a copy in Oregon or, if you do not have a copy, about the possibility of probating your grandmother's estate as an heirship. Note why your grandfather would not be a suitable person to administer the estate (progressing dementia).
