Can a paper be drawn up by an attorney that if the other party agrees to cancel interest in a property that will probably go to probate. Can this be done to avoid probate all together so we can sell the property?
If the owner of the property has passed away and the property was not held in trust than you are going to have to run the property through probate. Has a probate been opened?
