Calif trust Law.

Asked on Dec 22nd, 2021 on Wills and Probate - California
More details to this question:
My mother died 6 years ago . She made me trustee of her estate . There was nothing in her estate and I did nothing at all. Now suddenly I have found a judgment she held on a piece of property. In Calif. I want to transfer that judgment from her name to mine. Is there a simple method I can use that would not require going into court. Possibly just sign it over to me as the trustee. Must I also file the change .

Hi, It should be easy to transfer the  judgment to your name since you are the trustee.  BUT that is assuming the judgment was part of the trust.  I would need to read the trust.  Otherwise, you might have to go to court to change the name of the judgment creditor.  How fast this can be done also depends upon the amount of the judgment.   I also happen to do a lot of collection work.  Is the judgment still valid?  When was it entered? Was it renewed?   I would need more information to give you difinitive answers.
