California No Will ....

Asked on Mar 06th, 2017 on Wills and Probate - California
More details to this question:
My Mother passed away (she lived in Adelanto, California) without a Will, I live in Washington. My uncle (her brother) lives close to where she lived. I don't want any of Mom's assets, I agree for my uncle to handle and get everything. So I agree to sign all her property over to him. What forms do I need to get then fill out to send to my uncle so he can handle & get everything?

Your uncle may need a probate lawyer to administer the estate in San Bernardino County, California.  You would sign an appointment of administrator and assignment of interest in the estate.  You can also waive notice so that your uncle doesn't have to send you notices of the probate proceeding.  Call an attorney in San Bernardino County for a full consultation.

Probate will need to be filed where your mother lived.  I would have your uncle get the forms and send them to you.  He will need to fill out most of them if he is seeking to administer the estate.  You just will have to sign a renunciation form, waiving your right to serve as her estate's executor, since you have priority over hims to serve in that role.  You may also want to waive notice, which means he would not be required to send you copies of various probate filings.  Eventually, he would want to send you a disclaimer form or some sort of written agreement by which you decline your right to your mother's estate's assets.  This is more for his protection than yours and part of his job if he is administering the estate so, again, I would have him send you the documents when the time comes.  I'm sorry for your loss.
