Can a lawyer who draws up a will and is executor back out of being it?

More details to this question:
The lawyer who is the executor of the will has now said they will not do it nor will the person they had as the fill in if they could not do it because there isn't any money in the estate. He has dumped it back in the family's lap. The new will was made in july 2102 Tis that ethical or legal?

I'm not sure its ethical, but if there is no money in the estate, why is anyone worried about serving as the executor? The executor is only needed if there are assets that need to be gathered and then distributed to the beneficiaries. If there are no assets, there is no need for an executor.
