My mother trusted my older brother to be fair and impartial when handlling the trust. etc..so she let him remain successor trustee in the living trust. He never provided a single accounting of bank accoiunts, properties, or any personal property she owned. nor any of the very expensive jewelery she owned. She made it clear to everyone that to avoid prpoblems it would be sold and the money divided. After she passed he completely left out the most valuable property which is a villa located on the beach in Rosarito Baja Ca. Its been appraised between 450 and $500,000.00 Nearly all the assets. He accounted for nothing she owned except two of the homes which were sold, and her vehicle that he took from me then sold to himself. He threatened to disinherit anyone who questioned his work. there was a clause saying for nobody to challenge or recieve $1 if you did. He stole everything. He then paid himself $37,000.00 for reimbursement. While he paid an estate company $3000 to handle this? Help
It really depends on how old this situation is. If this has happened fairly recently you most certainly have the ability to file suit against your brother. The threat to disinherit is largely a hollow one, because your brother has a legal duty to account to the beneficiaries and that clause would be thrown out if he has done anything improper.
