More details to this question:
My mom passed away without a living will. She has 3 children and one of us is a total disable, which has lived at the property more than 30yrs. My mom was married for 9yrs and he is not our father and he has basically kicked all of us out and changed the locks.... Is that legal?

State law determines who gets what when there is no Will.  Even when the surviving spouse is not entitled to full ownership, he often has a lifetime occupancy right.  Contact a probate lawyer who practices in the county in which your mother lived and died to protect your rights.
