My fiance Great Aunt left him CD to be POD. Before her death a conservative was put over finances due to illness. When conservative renewed CD she didn't put his name back on it, but it was clearly left to him, what can he do? He's now told he can only have half of money from CD and other have goes into estate to be divided. No will was found. Can it be divided? His lawyer first said it was clearly his and he was entitled to it now more than year later hasn't gotten it and the lawyer is now saying it's to be divided
That lawyer knows more of the facts than anyone on this listserv. You might ask him or her to explain why the answer changed. Maybe new facts emerged. Maybe the law changed. It appears that now the CD is part of the probate process. Because debts must be paid and a final tax return filed, it may well be more than a year before a distribution is made.
