From VivianaTribble, my dad Juse passed away on dec.2. Will was made according to Terry Canales, jr. There were descrepancies about our conversation. First, he said it was probably Planned, because he came to our office1-2 weeks before his passing. (My dad was in hospital at that time.) Then he later recanted, saying he did not know the date. First he said he was the lawyer, then I said, I was going to Contest will. He said — it did not matter, I do not have a dog in the fight, I have nothing to do with that, I am not the lawyer. Canales said when he came to our office, he was of sound mind—then later he said he looked tired and sick. Canales, in will, he left everything my step siblings. He was prescribed anti- depressant medication., with wife passing Oct. 14– Mental status is questionable—he Shot himself.

From your description, it is not clear whether a Will has been submitted to a court for probate (proving) or what evidence you may have, if any, that the decedent lacked legal capacity to make a Will when he did so.
